A: Terms and Conditions
 

• By submitting the Artist Registration Form to ( galleria@igastudios.com) you acknowledge that you are bound by the terms and conditions listed below. 

• There is no hosting charge to be on the website. 

• The price of the artwork listed in the Artwork Description Table should be inclusive of all taxes, packaging and the IGA Galleria percentage as mentioned in the Artist Registration Form. IGA Galleria commission is subject to change. 

• Please note that after you have submitted the entries via mail, they may take anything between 12-15 days to appear on the website. They are subject to approval before they are loaded, no queries will be entertained on this regard. All decisions of IGA Galleria will be final and binding on all artists. 

• All information provided in an application must be true, accurate and complete. 

• Once a buyer has bought an artwork, you will get an email informing you of the same, our shipping company will come and pick up your work within 5 days. 

• Please ensure that all artworks are packed properly and should be wrapped in bubble paper, put in PVC tubes or also crated in a wooden box if necessary before it is picked up by the courier company. 

• Please note that all damaged works will be returned back and courier charges would be debited to the artists. We will take the buyers word as final in this matter as a principle of good faith. 

• The Art shall be and remain the risk of the Artist until it is shipped to the buyer, and thereafter the risk shall shift to the buyer. 

• Please make a special note that IGA Galleria is informed immediately in case of sale through other sources of any artworks given to us for uploading. This is to ensure that collectors get confirmed delivery and when a collector books a work, he is not told that it is already sold. 

• All artwork, if submitted for display on the Website through the Artwork Description Table, is considered to be authentic. Based on which, IGA Galleria will issue a specific authenticity guarantee to its Clients for every artwork sold through the Website.  

• The Artist is the retailer for sales tax purposes and shall file all sales tax returns in accordance with applicable laws. 

• The trademarks, trade names, designs and all material contained on this Site, including all portions of the website, content, site design, text, graphics, and all intellectual property rights thereto ("Site Content") are the sole and exclusive property of IGA Galleria or its licensors. The use of any such property for any other reason, on any other website, or the modification, distribution or republication of this material without the prior written permission of IGA Galleria, is strictly prohibited. Any unauthorized use terminates the permission or license granted by IGA Galleria. 

• These Terms of Service comprises the entire agreement between you and IGA Galleria and supersedes all prior agreements between the parties, regarding the subject matter contained herein. All provisions in these Terms and Conditions regarding representations and warranties, indemnification, disclaimers and limitations on liability shall survive any termination of these Terms and Conditions.

• Both parties reserve the right to terminate this contract for any reasonable cause, by issuing a two week notice in writing.

• IGA Galleria strongly believes in the security of your privacy, your information is completely private and confidential with us. The information you provide to IGA Galleria is only used to serve your needs better and make your experience at our website more enjoyable.

C: Disclaimer
 

• IGA Galleria reserves the right to change the terms, conditions, and notices under which the Site is offered. You are responsible for regularly reviewing these terms and conditions. 

• By providing or submitting your Artwork, you are granting IGA Galleria permission to use your submission in connection with the operation of the web site including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your submission; and to publish your name in connection with your Submission/Artwork. 

• We do not warrant that all submissions will be available on our website. If we elect in our sole discretion to make available content on our website, we do not warrant that it will be available within a certain time frame.

• In no event shall IGA Galleria be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the sites, with the delay or inability to use the sites or related services, the provision of or failure to provide services, or for any information, products, services and related graphics obtained through the sites, or otherwise arising out of the use of the sites, whether based on contract, tort, negligence, strict liability or otherwise. If you are dissatisfied with any portion of the sites, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the sites. 

• While great care is taken to reproduce the colours and form of paintings on the website, it is understood that since it is a digital depiction there may be variations in shade and colour. No complaints in this regard would be entertained.

• IGA Galleria assumes no responsibility for any defect, delay, theft or destruction of original art works, paintings and sculptures during the shipping process.
